By accessing and using the Dirty Freehub Site (the “Site”), you are agreeing to be bound by these Terms of Service (the “Terms”). If you do not agree with these Terms, please do not use the Site. In addition, you must be at least 18 [eighteen] years of age to use this Site. By using this Site and by agreeing to these Terms, you warrant and represent that you are at least 18 years of age.

Dirty Freehub reserves the right to modify or replace these Terms at any time. We will strive to provide at least 30 days notice prior to any new terms taking effect. By continuing to access or use our Site after any revisions become effective, you agree to be bound by the revised terms.

IV. ACCEPTABLE USE

Unless otherwise stated, Dirty Freehub and/or its licensors own the intellectual property rights published on this Site and materials used on the Site. Subject to the license below, all these intellectual property rights are reserved.

Dirty Freehub grants you a limited license to access and use the Site for personal use. You are permitted to view and print pages from the Site and download GPX files for personal use only. This content, including pages and GPX files, must not be used for commercial purposes or shared with group activities such as bike clubs, Facebook groups, or similar mediums. Downloading for caching purposes is permitted. You are allowed to link to pages within the Site, but the use of iframe code or other types of embeds is strictly prohibited.

You must not use this Site in any way that causes or may cause damage to the Site or impairment of the availability or accessibility of Dirty Freehub.org or in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.

You must not use this Site to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit or other malicious computer software.

You must not conduct any systematic or automated data collection activities on or in relation to this Site without Dirty Freehub’s express written consent.

This includes:

  • scraping
  • data mining
  • data extraction
  • data harvesting
  • ‘framing’ (iframes)
  • Article ’spinning’

You must not use this Site or any part of it to transmit or send unsolicited commercial communications.
You must not use this Site for any purposes related to marketing without the express written consent of Dirty Freehub.

  • sell, rent or sub-license material from the Site;
  • show any material from the Site in public;
  • reproduce, duplicate, copy or otherwise exploit material on this Site for a commercial or club purpose;

  • redistribute material from this Site – except for content specifically and expressly made available for redistribution; or
  • republish or reproduce any part of this Site through the use of iframes or screen scrapers.

Where content is specifically made available for redistribution, it may only be redistributed within your organization.

Access to certain areas of this Site is restricted. Dirty Freehub reserves the right to restrict access to certain areas of this Site or, at our discretion, this entire Site.

If Dirty Freehub provides you with a user ID and password to enable you to access restricted areas of this Site or other content or services, you must ensure that the user ID and password are kept confidential. You alone are responsible for your password and user ID security.

Dirty Freehub may disable your user ID and password at Dirty Freehub’s sole discretion without notice or explanation.

All content included in or made available through the Site, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of Dirty Freehub or its content suppliers and protected by international copyright laws.

In these terms and conditions, “your user content” means material (including without limitation text, images, audio material, video material and audio-visual material) that you submit to this Site for whatever purpose.
You grant Dirty Freehub a worldwide, irrevocable, non-exclusive, royalty-free license to use, reproduce, adapt, publish, translate and distribute your user content in any existing or future media. You also grant Dirty Freehub the right to sub-license these rights and the right to bring an action for infringement of these rights.
Your user content must not be illegal or unlawful, must not infringe any third party’s legal rights, and must not be capable of giving rise to legal action, whether against you or Dirty Freehub or a third party (in each case under any applicable law).

You must not submit any user content to the Site that is or has ever been the subject of any threatened or actual legal proceedings or other similar complaints.

Dirty Freehub reserves the right to edit or remove any material submitted to this Site or stored on the servers of Dirty Freehub or hosted or published on this Site.

Dirty Freehub’s rights under these terms and conditions in relation to user content, Dirty Freehub does not undertake to monitor the submission of such content to, or the publication of such content on, this Site.

VIII. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

The Site and all information, content, materials, products and other services included on or otherwise made available to you through the Site are provided by Dirty Freehub on an “as is” and “as available” basis. Dirty Freehub makes no representations or warranties of any kind, express or implied, as to the operation of the Site or the information, content, materials, products or other services included on or otherwise made available to you through the Site.

IX. INDEMNIFICATION

You agree to indemnify, defend and hold harmless Dirty Freehub, its officers, directors, employees, agents and third parties for any losses, costs, liabilities and expenses (including reasonable attorneys’ fees) relating to or arising out of your use of or inability to use the Site or services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations.

X. TERMINATION / ACCESS RESTRICTION

Dirty Freehub reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time without notice.

XI.GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Dirty Freehub operates. If any provision of this Site disclaimer is or is found to be, unenforceable under applicable law, that will not affect the enforceability of the other provisions of this Site disclaimer.

XII. REASONABLENESS

By using this Site, you agree that the exclusions and limitations of liability set out in this Site disclaimer are reasonable. If you do not think they are reasonable, you must not use this Site.

XIII. BREACHES OF THESE TERMS AND CONDITIONS

Without prejudice to Dirty Freehub’s other rights under these terms and conditions, if you breach these terms and conditions in any way, Dirty Freehub may take such action as Dirty Freehub deems appropriate to deal with the breach, including suspending your access to the Site, prohibiting you from accessing the Site, blocking computers using your IP address from accessing the Site, contacting your internet service provider to request that they block your access to the Site and/or bringing court proceedings against you.

XIV. ASSIGNMENT

Dirty Freehub may transfer, sub-contract or otherwise deal with Dirty Freehub’s rights and/or obligations under these terms and conditions without notifying you or obtaining your consent. You may not transfer, sub-contract or otherwise deal with your rights and/or obligations under these terms and conditions.

XV. SEVERABILITY

If a provision of these terms and conditions is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect. If any unlawful and/or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.
